PART 1 - CRIMINAL OFFENSES

 


TITLE 1 – OF CRIMES AGAINST THE PERSON

101. Aggravated Murder (F)
Any person who deliberately takes the life of a police officer, firefighter, paramedic, prosecutor, judge, juror, or other elected official while in the commission of their duty, or any witness in a criminal proceeding is guilty of a Class A felony, punishable by a sentence of 8 Hours.

102. Murder (F)
1. Any person who causes the death of another person, with intent to cause the death of such person through premeditated actions is guilty of a Class A felony, punishable by a sentence of 7 Hours.

This offense shall be known as Murder in the First Degree.

2. Any person who causes the death of another person, with intent to cause the death of such person through unpremeditated actions is guilty of a Class A felony, punishable by a sentence of 6 Hours.

This offense shall be known as Murder in the Second Degree.

103. Manslaughter (F)
Any person who engages in the unintentional killing of a human being without malice, with or without a sudden quarrel or heat of passion is guilty of a Class A felony, punishable by a sentence of 3 Hours.

104. Menacing (M)
Any person who unlawfully attempts to commit a violent injury on the person of another or attempts to put another person they are in the presence of in reasonable fear of physical injury is guilty of a Class B misdemeanor, punishable by a sentence of 30 Minutes.

105. Menacing a Peace Officer (F)
Any person who unlawfully attempts to commit a violent injury on a peace officer engaged in the performance of his or her duties or attempts to put a peace officer in reasonable fear of physical injury is guilty of a Class A felony, punishable by a sentence of 45 Minutes.

106. Assault (M) (F)
1. Any person who engages in willful and unlawful use of physical force upon another individual is guilty of a Class B misdemeanor, punishable by a sentence of 45 Minutes.
This offense shall be known as Assault in the Second Degree.

2. Any person who engages in willful and unlawful use of physical force upon another individual, resulting in serious bodily injury is guilty of a Class B felony, punishable by a sentence of 1 Hour.
This offense shall be known as Assault in the First Degree.

107. Vehicular Assault (F)
Any person who drives or operates a vehicle or machinery while unlawfully intoxicated or impaired by the use of alcohol or a drug in a manner that causes physical injury to another person is guilty of a Class A or B felony, punishable by a sentence of 2 Hours.

108. Assault on a Peace Officer (F)
Any person who engages in willful and unlawful use of physical force upon a peace officer engaged in the performance of his or her duties is guilty of a Class B felony, punishable by a sentence of 1.5 Hours.

109. Assault with a Deadly Weapon (F)
1. Any person who unlawfully attempts to commit a violent injury on the person of another while in possession of a deadly weapon or instrument other than a firearm is guilty of a Class B felony, punishable by a sentence of 1 Hours.

This offense shall be known as Assault with a Deadly Weapon in the Second Degree.


2. Any person who unlawfully attempts to commit a violent injury on the person of another while in possession of a firearm is guilty of a Class B (5) felony, punishable by a sentence of 2 Hours.

This offense shall be known as Assault with a Deadly Weapon in the First Degree.


110. Assault with a Weapon on a Peace Officer (F)
1. Any person who unlawfully attempts to commit a violent injury on a peace officer engaged in the performance of his or her duties while in possession of a deadly weapon or instrument other than a firearm is guilty of a Class B felony, punishable by a sentence of 2 Hours.

This offense shall be known as Assault with a Deadly Weapon on a Peace Officer in the Second Degree.


2. Any person who unlawfully attempts to commit a violent injury on a peace officer engaged in the performance of his or her duties while in possession of a firearm is guilty of a Class B felony, punishable by a sentence of 3 Hours.

This offense shall be known as Assault with a Deadly Weapon on a Peace Officer in the First Degree.

112. False Imprisonment (M)
Any person who forcibly, or by any other means of instilling fear, holds, detains, restrains, or unlawfully arrests another person is guilty of a Class C misdemeanor, punishable by a sentence of 45 Minutes.

113. Kidnapping (F)
Any person who forcibly, or by any other means of instilling fear, steals or takes, or holds, detains, or unlawfully arrests any person with the intent to carry that person into another country, state, or county, or into another part of the same county is guilty of a Class B felony, punishable by a sentence of 2 Hours.

114. Human Trafficking (F)
Any person who through coercion, violence, force or other illicit means deprives someone of their personal liberty with the intent to obtain forced labor or services from them or with the intent to violate Liberty City’s pimping and pandering laws is guilty of a Class B felony, punishable by a sentence of 3 Hours.

115. Torture (F)
Any person who with the intent to cause cruel or extreme pain and suffering for the purpose of revenge, extortion, persuasion, or for any sadistic purpose, inflicts great bodily injury on another is guilty of a Class A  or B felony, punishable by a sentence of 2 Hours.

116. Extortion (F)
Any person who compels or threatens another person to deliver money, property, services, or other material gains, or to neglect an official act of duty under threats of physical violence, property damage, or public humiliation is guilty of a Class B felony, punishable by a sentence of 1 Hours.

117. Robbery (F)
Any person involved in the unlawful taking of personal property in the possession of another, from his person, or immediate presence, and against his will by means of force or fear is guilty of a Class B (4) felony, punishable by a sentence of 1 Hours.

118. Armed Robbery (F)
Any person who unlawfully takes another’s property from his or her person or immediate possession when accomplished by force or fear with the use of a dangerous instrument or weapon of any type, improvised or not is guilty of a Class B felony, punishable by a sentence of 3 Hours.

119. Harassment (I)
Any person who engages in a course of conduct, or repeatedly commits acts directed at a specific person, that alarm or seriously alarm the person, and that serve no legitimate purpose after receiving verbal or written communication to cease is guilty of an infraction, punishable by a sentence of $5.000.

120. Criminal Threats (M)
Any person who willfully threatens to commit a crime which would reasonably be believed to result in death or great bodily injury to another person and is made verbally, in writing, or by means of an electronic communication device, while not physically present of that individual is guilty of a Class B misdemeanor, punishable by a sentence of 30 Minutes.

TITLE 2 – OF CRIMES AGAINST PUBLIC DECENCY AND GOOD MORALS

204. Indecent Exposure (M)
Any person who willfully lewdly exposes their person, or the private parts thereof, in any public place, or in any place where there are present other persons is guilty of a Class C misdemeanor, punishable by a sentence of 30 Minutes.

205. Public Lewdness (M)
Any person who engages solicits anyone to engage in lewd or dissolute or grossly inappropriate sexual conduct in any public place or in any place open to the public or exposed to public view is guilty of a Class C misdemeanor, punishable by a sentence of 30 Minutes.

206. Stalking (M)
Any person who willfully, maliciously, and repeatedly follows or willfully and maliciously harasses another person, and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family is guilty of a Class B misdemeanor, punishable by a sentence of 50 Minutes.

207. Prostitution (M)
Any person who encourages or persuades a person to engage in sexual activity for monetary or other material gain, whether it be the prostitute or the customer is guilty of a Class C misdemeanor, punishable by a sentence of 50 Minuts.

208. Solicitation of a Prostitute (M)
A person who offers payment, goods, services or other items of value to an individual in exchange for sexual acts is guilty of a Class C misdemeanor, punishable by a sentence of 50 Minutes.

209. Promoting Prostitution (F)
Any person who solicits or advertises, aids, or provides transport or otherwise supervises persons involved in prostitution and retains money earned during the commission of the offense of prostitution or any person who causes, induces or encourages another person to become a prostitute by promises, threats, violence or any scheme is guilty of a Class C felony, punishable by a sentence of 1 Hour.

210. Child Abuse (F)
Any person who willfully inflicts upon a child under 18 years old any cruel or inhumane corporal punishment or an injury resulting in a traumatic condition, or puts a child in a situation or circumstance that invites great bodily harm or injury, or causes minor harm or injury to the child is guilty of a Class A, or B felony, punishable by a sentence of 2 Hours.

211. Child Neglect (F)
Any person who fails to provide physical necessities such as clothing, food, shelter, and medical or other remedial care for his/her minor child without a lawful excuse is guilty of a Class A or felony, punishable by a sentence of 1 Hour.

212. Sale of Alcohol / Tobacco to a Minor (M)
Any person who willfully and knowingly sells alcohol and/or tobacco to an individual under the age of 21 is guilty of a Class C misdemeanor, punishable by a sentence of 30 Minutes.

213. Minor Alcohol / Tobacco Violation (M)
Any person under the age of 21 who is in possession of alcohol, alcohol-based products, or appears to be under the influence of alcohol, or any tobacco-based products is guilty of a Class C misdemeanor, punishable by a sentence of 30 Minutes.

214. Animal Abuse (F)
Any person who maliciously and intentionally maims, mutilates, tortures, assaults, wounds, or kills a living animal, or holds ownership to a pet that is not considered domesticated and safe for the animal or the owner is guilty of a Class A or B felony, punishable by a sentence of 1 Hour.

TITLE 3 – OF CRIMES AGAINST PUBLIC HEALTH AND SAFETY

304. Possession of a Controlled Substance (M)
Any person who possesses less than 40 grams of any controlled substance or multiple controlled substances, except when dispensed or prescribed by or under the direction of a person licensed by the state to dispense, prescribe, or administer controlled substances is guilty of a Class C misdemeanor.

Schedule

Punishment

I

A monetary fine of up to $2,500 and a term of imprisonment no greater than 10 hours.

II

A monetary fine of up to $1,750 and a term of imprisonment no greater than 5 hours.

III

A monetary fine of up to $1,000 and a term of imprisonment no greater than 2 hours.

IV

A monetary fine of up to $500 and a written or verbal warning.

Schedule I shall consist of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section:

(a) Benzylmorphine
(b) Crack Cocaine
(c) Cocaine
(d) Heroin
(e) Opium

Schedule II shall consist of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section:

(a) Amphetamines
(b) Ecstasy
(c) Ketamine
(d) Methamphetamine
(e) Lysergic Acid Diethylamide

Schedule III shall consist of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section:

(a) Disubstituted Barbituric Acids
(b) Methadone
(c) Morphine
(d) Oxycodone
(e) Any other medically prescribed controlled substance

Schedule IV shall consist of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section:

(a) Cannabis

(b) Cannabinoids

305. Possession Of A Controlled Substance with Intent to Distribute (M)
Any person who possesses any controlled substance or multiple controlled substances with the intent to distribute, deliver, or sell who possesses any controlled substance or multiple controlled substances in excess of measurements of  40 grams, regardless of individual intent is guilty of a Class C misdemeanor.

Schedule

Punishment

I

A monetary fine of up to $15,000 and a term of imprisonment no greater than 40 Minutes.

II

A monetary fine of up to $10,500 and a term of imprisonment no greater than 40 Minutes.

III

A monetary fine of up to $7,000 and a term of imprisonment no greater than 40 Minutes.

IV

A monetary fine of up to $5,250 and a term of imprisonment no greater than 30 Minutes.

306. Operating as a Major Trafficker (F)
Any person who attempts, or is successful in the act of transporting, exporting, storing or concealing a controlled substance or multiple controlled substances on their person or in their property in excess of measurements of 46 grams, but no more than 250 grams, is guilty of a Class C (5) felony.
This offense shall be known as Operating as a Major Trafficker in the Third Degree.

Punishment

I

A monetary fine of up to $22,500 and a term of imprisonment no greater than 1.5 Hour.

II

A monetary fine of up to $18,750 and a term of imprisonment no greater than 1 Hour.

III

A monetary fine of up to $15,000 and a term of imprisonment no greater than 1 Hour.

IV

A monetary fine of up to $11,500 and a term of imprisonment no greater than 40 Minutes.

Any person who attempts, or is successful in the act of transporting, importing, exporting a controlled substance or multiple controlled substances on their person or in their property in excess of measurements of 250 grams, but no more than 500 grams, is guilty of a Class C (5) felony.
This offense shall be known as Operating as a Major Trafficker in the Second Degree.

A monetary fine of up to $30,000 and a term of imprisonment no greater than 2 Hours.

II

A monetary fine of up to $27,500 and a term of imprisonment no greater than 2 Hours.

III

A monetary fine of up to $22,000 and a term of imprisonment no greater than 1 Hour.

IV

A monetary fine of up to $19,500 and a term of imprisonment no greater than 1 Hour.

Any person who attempts, or is successful in the act of transporting, importing, exporting a controlled substance or multiple controlled substances on their person or in their property in excess of measurements of 500 grams is guilty of a Class C felony.
This offense shall be known as Operating as a Major Trafficker in the First Degree.

A monetary fine of up to $45,000 and a term of imprisonment no greater than 3 Hours.

II

A monetary fine of up to $37,500 and a term of imprisonment no greater than 2 Hours.

III

A monetary fine of up to $30,000 and a term of imprisonment no greater than 2 Hours.

IV

A monetary fine of up to $22,500 and a term of imprisonment no greater than 1.5 Hours.

307. Manufacture of a Controlled Substance (F)

Any person who manufactures, compounds, converts, produces, derives, processes, or prepares, either directly or indirectly by chemical or natural extraction any illegal or prescription substance without proper permits is guilty of a Class C felony.

I

A monetary fine of up to $50,000 and a term of imprisonment no greater than 2.5 Hours.

II

A monetary fine of up to $45,000 and a term of imprisonment no greater than 2 Hour.

III

A monetary fine of up to $40,000 and a term of imprisonment no greater than 2 Hour.

IV

A monetary fine of up to $15,000 and a term of imprisonment no greater than 1 Hour.

308. Criminal Sale of a Controlled Substance (F)
Any person who knowingly and unlawfully sells one or more preparations, compounds, or mixtures containing controlled substances is guilty of a Class C felony, punishable by a sentence of 1 Hour.

308. Criminally Using Drug Paraphernalia (M)
Any person who knowingly possesses any device, instrument or paraphernalia used for or designed for unlawfully injecting or smoking a controlled substance, packaging, measuring or weighing controlled substances such as gelatine capsules, vials, capsules, scales or glassine envelopes is guilty of a Class C misdemeanor, punishable by a sentence of 50 Minutes.

309. Eavesdropping (F)
Any person who unlawfully engages in wiretapping, mechanical overhearing of a conversation, or intercepting or accessing of an electronic communication is guilty of a Class C felony, punishable by a sentence of 1 Hour.

310. Facial Obstruction (M)
Any person who obstructs or disguises their face, during the commission of a crime, shall be charged under this statute is guilty of a Class C misdemeanor, punishable by a sentence of 30 Minutes.

311. Drive-by Shooting (F)
Any person who discharges a firearm from a motor vehicle at another person or any person who knowingly permits another person to discharge a firearm from their vehicle is guilty of a Class C felony, punishable by a sentence of 3 Hours.

312. Littering (I)
Any person who discards, drops, or scatters waste matter in a place other than a container or proper disposal, in a public or private property, other than his or her own property is guilty of an infraction punishable by a fine of $1,000.

TITLE 4 – OF CRIMES AGAINST PUBLIC PEACE

401. Unlawful Assembly (M)
1. Any person who refuses to disperse or leave a public facility or ground without possessing a valid permit and has been ordered to leave by law enforcement; or
2. Any person who assembles with two or more people to engage or prepare to engage in violent, boisterous, tumultuous, or violent conduct likely to cause public alarm is guilty of a  Class C misdemeanor, punishable by a sentence of 30 Minutes.

402. Incitement to Riot (F)
Any person who, with the intent to cause a riot, engages in tumultuous or violent conduct that urges a riot, or urges others to commit acts of force, violence, or destruction of property under circumstances that create public alarm is guilty of a Class C felony, punishable by a sentence of 1 Hour.

403. Disorderly Conduct (M)
Any person who intends to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof and:
1. He engages in fighting or in violent or threatening behavior; or
2. He makes unreasonable noise; or
3. In a public place, he uses abusive or obscene language, or makes an obscene gesture; or
4. He obstructs vehicular or pedestrian traffic
is guilty of a Class C misdemeanor, punishable by a sentence of 30 Minutes or a fine of $5.000.

404. Brandishing a Firearm (F)
Any person who, except in self-defense, draws or exhibits a firearm, whether loaded or unloaded, in an angry or threatening manner as to reasonably induce fear in the mind of another is guilty of a Class B felony, punishable by a sentence of 1.5 Hour.

405. Brandishing a Deadly Weapon (F)
Any person who, except in self-defense, in the presence of another person, draws, holds, points, or exhibits a deadly weapon or instrument, other than a firearm, in a rude, angry, or threatening manner as to reasonably induce fear in the mind of another is guilty of a Class B felony, punishable by a sentence of 1 Hour.

406. Unlawfully Discharging a Firearm (F)
Any person who, except in self-defense, intentionally discharges a firearm into any building, vehicle, or in a public or other populated area, causing severe endangerment, actual physical harm, or risk of physical harm to another person is guilty of a Class A or Class B felony, punishable by a sentence of 2 Hours.

Title 5 – OF CRIMES AGAINST PROPERTY

501. Burglary (F)
Any person who enters or unlawfully remains in any unoccupied publicly or privately owned commercial or residential structure, with the intent to procure items through illicit means, or with intent to commit a crime there is guilty of a Class C felony, punishable by a sentence of 1 Hour.

503. Arson (F)
A person who willfully and maliciously sets fire to or burns or causes to be burned or who aids or advises the burning of, any structure, forest land, or property is guilty of a Class C felony, punishable by a sentence of 2 Hours Days.

504. Theft (M)
Any person who steals, takes, carries, leads, or drives away the personal property of another individual or organization in value of $5,500 or less. This charge also includes petty theft of services, which is the intentional failure to pay for rendered services valued at $5,500 or less is guilty of a  Class C misdemeanor, punishable by a sentence of 30 Minutes.

505. Grand Theft (F)
Any person who steals, takes, carries, leads, or drives away the personal property of another individual or organization in value of $5,501 or more. This charge also includes petty theft of services, which is the intentional failure to pay for rendered services valued at $5,501 or more is guilty of a Class C felony, punishable by a sentence of 1 Hour.

506. Grand Theft of a Vehicle (F)
Any person who steals or attempts to steal or who takes, leads, or drives away another person’s vehicle, without their permission. This charge also includes breaking into a parked vehicle, with or without the attempt to steal the vehicle itself is guilty of a Class C felony, punishable by a sentence of 1.5 Hours.

507. Grand Theft Of A Firearm (F)
Any person who commits theft of any firearm, no matter the value is guilty of a Class C felony, punishable by a sentence of 1 Hours.

508. Possession of Burglary Tools (M)
Any person having upon him or her in his or her possession a picklock, crow, key bit, crowbar, screwdriver, tension bar, lock pick gun, master key, or other instrument or tool with intent to breach a lock without possession of proper licensing is guilty of a  Class C misdemeanor, punishable by a sentence of 30 Minutes.

509. Receiving Stolen Property (M)
Any person who buys or receives any property that has been stolen or that has been obtained in any manner that constitutes theft or extortion with knowledge of status is guilty of a  Class C misdemeanor, punishable by a sentence of 30 Minutes.

510. Trespassing (M)
Any person who enters another's property with the intent to interfere with or obstruct the business activities conducted thereon, or enters and occupies another's property without permission, or refuses to leave private property after being asked by an owner, manager, resident, or employee is guilty of a  Class C misdemeanor, punishable by a sentence of 45 Minutes.

511. Vandalism (M)
Any person who defaces, damages, or destroys property not his or her own. Does not extend to burning is guilty of a  Class C misdemeanor, punishable by a sentence of 45 Minutes.

513. Fraud (F)
A person who knowingly, by any false or fraudulent representation or pretense, defrauds any other person of money, labor, property, or other services is guilty of a Class C felony, punishable by a sentence of 1 Hour.

TITLE 6 – OF CRIMES AGAINST PUBLIC JUSTICE

601. Bribery (F)
Any person who confers, or offers, or agrees to confer money, goods, services, benefits, or anything of value to a public employee to improperly influence that individual’s official action, opinion, judgment, decision, or exercise of discretion as a public servant is guilty of a Class C (4) felony, punishable by a sentence of 45 Minutes.

602. Corrupting the Government (F)
Any person who, while employed by a municipal, county, or state level agency or organization, or any person acting in concert with a public servant's act with the intent to defraud the government, or any segment thereof to obtain property, actual service, resources or preferential treatment by false or fraudulent pretenses, representations or promises is guilty of a Class C felony, punishable by a sentence of 1 Hour.

604. Resisting Arrest (M)

Any person who intentionally prevents or attempts to prevent a peace officer from effecting an authorized arrest is guilty of a Class C misdemeanor, punishable by a sentence of 40 Minutes.

605. Obstructing Governmental Administration (F)
Any person who shows a clear and motivated attempt to prevent or delay a state employee from conducting their lawful duties, by means of intimidation, physical force or interference is guilty of a  Class C felony, punishable by a sentence of 50 Minutes.

606. Tampering with Evidence (F)
Any person who knowingly alters, modifies, manufactures, plants, places, destroys, damages, conceals, or moves anything used as evidence with the intent to prevent, mislead or hinder a legal proceeding or otherwise produce a deceptive effect at such proceeding is guilty of a Class C felony, punishable by a sentence of 1 Hour.

607. Intimidating a Victim or Witness (F)
Any person who knowingly and maliciously prevents or dissuades or who attempts to prevent or dissuade a witness or victim, from attending or providing testimony at any judicial proceeding or inquiry, or making a report that could lead to criminal action being taken is guilty of a Class B felony, punishable by a sentence of 2 Hours.

608. Perjury (F)
1. Any person who, having taken an oath that they will testify, declare, depose, or certify truly before any competent tribunal, officer authorized to administer oaths by the state of Liberty, or in a court sitting willfully and contrary to the oath, states as true any material matter which they know to be false  is guilty of a Class C felony, punishable by a sentence of 1 Hour.

609. Aiding and Abetting (F) *
Any person who renders criminal assistance to a person is guilty of a Class C felony, punishable by a sentence of 1 Hour.

A person "renders criminal assistance" when, with intent to prevent, hinder or delay the discovery or apprehension of, or the lodging of a criminal charge against, a person who he knows or believes has committed a crime or is being sought by law enforcement officials for the commission of a crime, or with intent to assist a person in profiting or benefiting from the commission of a crime, he:

(a) Harbors or conceals such person; or
(b) Warns such person of discovery or apprehension; or
(c) Provides such person with money, transportation, weapon, disguise or other means of avoiding discovery or apprehension; or
(d) Prevents or obstructs, by means of force, intimidation or deception, anyone from performing an act that might aid in the discovery or apprehension of such person or in the lodging of a criminal charge against him; or
(e) Suppresses, by any act of concealment, alteration or destruction, any physical evidence which might aid in the discovery or apprehension of such person or in the lodging of a criminal charge against him; or
(f) Aids such person to protect or expeditiously profit from an advantage derived from such crime.

614. Forgery (M)
Any person who knowingly creates, completes or alters a written instrument, with the intent to defraud, deceive or injure another is guilty of a  Class C misdemeanor, punishable by a sentence of 50 Minutes.

615. Falsely Reporting an Incident (M)
Any person who reports to any peace officer or a district attorney that a felony or misdemeanor has been committed, knowing the report to be false is guilty of a  Class C misdemeanor, punishable by a sentence of 50 Minutes.

617. Failure To Pay A Fine (M)
Any person who fails to pay a fine or court-ordered fee within clearly stated and allotted time period is guilty of a  Class C misdemeanor, punishable by a sentence of 40 Minutes.

618. Obstructing a Police Animal (F)
Any person who willfully and maliciously, and with no legal justification, interferes with or obstructs any animal being used by a peace officer in the discharge or attempted discharge of their duties by frightening, teasing, agitating, harassing, or hindering the animal is guilty of a  Class C (2) felony, punishable by a sentence of 1 Hour.

619. Injuring a Police Animal (F)
1. Any person who willfully with no legal justification, strikes, beats, kicks, cuts, stabs, shoots, poisons, or otherwise injures a peace officer's animal that is working at the supervision of a peace officer is guilty of a  Class C felony, punishable by a sentence of 1.5 Hours.

619. Killing a Police Animal (F)
2. Any person who, in violation of provisions (a) and (b), and with intent to inflict that injury or death, personally causes the death, or serious physical injury including loss or impairment of function of any bodily member or serious crippling is guilty of a Class C felony, punishable by a sentence of 2 Hours.

620. Lying to Government Agents (M)
Any person who knowingly and willfully makes any materially false, fictitious, or fraudulent statement or representation in any matter within the jurisdiction of the executive, legislative or judicial branch of the United States is guilty of a  Class C misdemeanor, punishable by a sentence of 45 Minutes.

621. Misuse of an Emergency Hotline (M)
Any person who uses a government hotline, intended for either emergency or non-emergency assistance, with a purpose other than contacting the government with a legitimate concern or ushering for immediate assistance, including prank calls, jokes, or any other kind of distraction is guilty of a  Class C misdemeanor, punishable by a sentence of 40 Minutes.

622. False Personation (M)
Any person who presents themselves as another or pretends to be a licensed practitioner, or representative of some person or organization or impersonates another by communication by internet website or electronic means and does an act in such pretended capacity with intent to obtain a benefit or to injure or defraud another is guilty of a  Class C misdemeanor, punishable by a sentence of 45 Minutes.

623. Impersonation of a Government Worker (F)
Any person who pretends to be a public servant, wears or displays without authority any uniform, badge, or insignia by which such public servant is lawfully distinguished, or falsely expresses by his words or actions that he is a public servant and so acts with intent to induce another to submit to such pretended official authority is guilty of a  Class C felony, punishable by a sentence of 1 Hour.

628. Escape (F)

Any person who, when having been arrested for, charged with or convicted of a criminal offense, escapes a detention facility is guilty of a Class C felony, punishable by a sentence of 2 Hours.

TITLE 7 – OF CRIMES WITH A VEHICLE

701. Reckless Driving (M)
Any person who drives or uses any vehicle upon a public road without exercising proper care or caution such as by nearly striking pedestrians, entering pedestrian passageways or nearly causing severe harm of other motorists is guilty of a Class C misdemeanor, punishable by a sentence of 45 Minutes.

702. Felony Reckless Driving (F)
Any person who drives a vehicle upon a public road or highway without exercising proper care or caution so as to injure another person is guilty of a Class B (6) felony, punishable by a sentence of 1 Hour.

704. Evading a Peace Officer (F)
(a) Any person who, while operating or upon entering a motor vehicle, and with the intent to evade, willfully flees or otherwise attempts to elude a pursuing peace officer's vehicle during a criminal episode is guilty of a Class C (5) felony, punishable by a sentence of 1 Hour.
(b) A criminal episode of Evading a Peace Officer shall be deemed interrupted only after the offender has been arrested for their attempt(s) to evade.

(c) Any vehicle involved in the commission of this offense may be impounded for up to 10 Days.

705. Aerial Evasion (F)
Any person who evades any law enforcement agency via an aircraft, whether as a pilot or passenger is guilty of a Class C (5) felony, punishable by a sentence of 2 Hours.

706. Reckless Operation Of An Aircraft (F)
Any person who endangers life through the operation of their aircraft, such as flying at low altitude in an urban or suburban area is guilty of a Class C felony, punishable by a sentence of 1 Day, and a fine of $40.000. A person guilty of this criminal offense shall have their pilot's license revoked and aircraft impounded.

707. Hit and Run (M) (F)
1. Any person who whilst operating a motor vehicle is involved in an accident resulting only in damage to property or other vehicles, and fails to immediately stop the vehicle at the scene of the accident is guilty of a Class C misdemeanor, punishable by a sentence of 45 Minutes.
2. Any person who while operating a motor vehicle is involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person and fails to immediately stop the vehicle at the scene of the accident is guilty of a Class B felony, punishable by a sentence of 1 Hour.

708. Driving under the Influence of Alcohol or Narcotics (M)
Any person who drives or operates a vehicle or machinery while under the influence of alcohol above the legal limit of 0.08% BAV under the influence of narcotics, regardless of whether those drugs are legal or illegal is guilty of a Class C misdemeanor, punishable by a sentence of 45 Minutes.

709. Street Racing (M)
Any person performing an unlicensed race or competition on city, county, or state paved roads or courses that demonstrates a potential for hazard is guilty of a Class C misdemeanor, punishable by a sentence of 45 Minutes.

TITLE 8 – OF CRIMES RELATING TO CONTROL OF DEADLY WEAPONS

801. Criminal Possession of a Firearm (M) (F)
1. Any person who carries a firearm, that is not a deadly weapon or destructive device, on their person, vehicle, place of business, or another private property without a firearms license, or possesses a firearm without a valid serial number is guilty of a Class C misdemeanor, punishable by a sentence of 50 Minutes.

This offense shall be known as Criminal Possession of a Firearm in the Third Degree.

2. Any person who carries more than one, but less than five units of firearms, that are not deadly weapons or destructive devices, on their person, vehicle, place of business, or another private property without a firearms license, or possesses more than one, but less than five units of firearms without a valid serial number is guilty of a Class C felony, punishable by a sentence of 1 Hour.

This offense shall be known as Criminal Possession of a Firearm in the Second Degree.

3. Any person who carries five or more units of firearms, that are not deadly weapons or destructive devices, on their person, vehicle, place of business, or another private property without a firearms license, or possesses fire or more units of firearms without a valid serial number is guilty of a Class C felony, punishable by a sentence of 2 Hours.

This offense shall be known as Criminal Possession of a Firearm in the First Degree.

802. Criminal Possession of a Deadly Weapon or Destructive Device (F)
1. Any person who possesses a machine gun, short-barreled rifle, short-barreled shotgun, modified weapon, scoped rifle, or explosive or incendiary device is guilty of a Class C (4) felony, punishable by a sentence of 1 Hours.

This offense shall be known as Criminal Possession of a Deadly Weapon or Destructive Device in the Third Degree.

2. Any person who possesses more than one, but less than four units of machine guns, short-barreled rifles, short-barreled shotguns, modified weapons, scoped rifles, or explosive or incendiary devices is guilty of a Class C (6) felony, punishable by a sentence of 2 Hours.

This offense shall be known as Criminal Possession of a Deadly Weapon or Destructive Device in the Second Degree.

3. Any person who possesses four or more units of machine guns, short-barreled rifles, short-barreled shotguns, modified weapons, scoped rifles, or explosive or incendiary device is guilty of a Class C (8) felony, punishable by a sentence of 3 Hours.

This offense shall be known as Criminal Possession of a Deadly Weapon or Destructive Device in the First Degree.

803. Criminal Possession of a Firearm by a Convicted Felon (F)
Any person who carries or possesses a firearm, deadly weapon or destructive device on their person, vehicle, place of business, or other facility they own or manage while being previously convicted of a felony offense under the penal laws of the State of Liberty is guilty of a Class C (4) felony, punishable by a sentence of 1.5 Hours.

804. Criminal Sale of a Firearm (F)
1. Any person who unlawfully sells, gives, or buys a firearm, that is not a deadly weapon or destructive device, without proper permits is guilty of a Class C (2) felony, punishable by a sentence of 1 Hour.


805. Criminal Sale of Deadly Weapon or Destructive Device (F)
1. Any person who unlawfully sells, gives, or buys a firearm, that is not a deadly weapon or destructive device, without proper permits is guilty of a Class C (3) felony, punishable by a sentence of 2 Hours.


806. Criminal Sale of a Firearm to a Minor (F)
Any person who sells, exchanges, gives or disposes of any type firearm to another person who is or reasonably appears to be less than eighteen years of age is guilty of a Class C (4) felony, punishable by a sentence of 2 Hours.


808. Reckless Endangerment with a Gun (F)
Any person who handles any firearm in a grossly negligent manner and creates risk of serious physical harm to another person is guilty of a Class C (3) felony, punishable by a sentence of 1 Hour.

TITLE  9 - VEHICULAR OFFENSES



901. Driving Without a Valid License (M)
1. Any person operating a motor vehicle under an expired license, or operating a motor vehicle without a license in any capacity is guilty of a Class C misdemeanor, punishable by a sentence of 40 Minutes.
2. Rentals and Airport leases are exempt from license requirement, and operate under temporary permit status as per agency issue.

902. Driving On A Suspended License (M)
Any person operating a motor vehicle at any time when that person's driving privilege is suspended or revoked is guilty of a Class C misdemeanor, punishable by a sentence of 1 Hour.

903. Operating an Aircraft Without A License (F)
Any person who operates any aircraft without the appropriate license is guilty of a  felony, punishable by a sentence of 1 Hour.

904. Vehicle Registration Violation (I)
Any person who drives, moves, or leaves standing upon a public road, any unregistered motor vehicle, or any motor vehicle that does not display an identification plate is guilty of an infraction, punishable by a fine of $5.000 and may have their vehicle impounded for up to 3 Days at the officer's discretion.

905. Driving without Insurance (I)
A person who drives, moves, or otherwise uses a vehicle on any public road without valid motor insurance is guilty of an infraction, punishable by a fine of $2.000 and may have their vehicle impounded for up to 3 Days at the officer's discretion.

906. Speeding (I)
1. Any person operating a motor vehicle on any road in a business district or residential area over the speed of 50 MPH shall be fined accordingly.

2. Any person operating a motor vehicle on any road, and not in a business district or residential area over the speed of 60 MPH shall be fined accordingly.
3. Any person operating a motor vehicle on any interstate highway over the speed of 90 MPH shall be fined accordingly.
4. Any person operating a motor vehicle at any speed greater than is reasonable having due regard for weather and visibility conditions shall be fined accordingly.

1st - $2.000 fine

2nd - $4.500 fine

3rd - $5.000 fine, 2 Days vehicle impound, and 3 Days license suspension


907. Illegal Parking (I)
Any vehicle parked:

(a) In a manner that obstructs a lane of traffic and prevents traffic from properly flowing.
(b) In a manner that obstructs an alleyway used by traffic and prevents traffic from entering and/or exiting the alleyway.
(c) In a manner that obstructs a parking lot and prevents vehicles from leaving or entering the lot.
(d) Within a marked crosswalk.
(e) On any sidewalk that completely obstructs pedestrian foot traffic, or on any median.
(f) Facing opposing traffic.
(g) On any bridge.
(h) Inside of any tunnel.
(i) On any freeway.
(j) On or within range of railroad tracks, where such a range poses the risk of the vehicle being struck by any railroad cars.
(k) In the immediate ambulatory parking or bay area of a hospital or clinic.
(l) In the immediate vicinity of the Bank's entrance, including the sidewalk adjacent to the metal barriers.
(m) In front of or obstructing a private driveway or an entrance or exit to a private road or path.
(n) Next to a fire hydrant, and/or on a fire lane marked by yellow lines.
(o) In a fashion that blocks the flow of traffic.
(p) On any part of a sidewalk.
(q) At or near a helipad or an aircraft landing zone, if in control of a non-aerial vehicle or in a manner that would obstruct the ground operation of aircraft.
(r) In any area that is clearly posted as a “no parking” or “loading” zone.
(s) Within the perimeter of any Government property while being in violation of the internal regulations of the agency in charge of the property.

1st - $1.000 fine

2nd - $2.500 fine

3rd - $5.000 fine and 3 Days vehicle impound at the officer's discretion

Any vehicle obstructing the flow of traffic or imposing a risk to traffic or pedestrian safety may be impounded for 1 Day.

 

908. Failure to Yield/Stop to a Traffic Control Device (I)
Any person operates vehicle and fails to follow traffic control devices, such as:

(a) Not yielding to an emergency vehicle with visible emergency lighting and sounding sirens;
(b) Crossing a double yellow line when NOT entering or leaving a parking lot or driveway;
(c) Ignoring signs, roadblocks, hand signals, or other equipment used by law enforcement to direct traffic;

1st - $1.000 fine

2nd - $2.500 fine

3rd - $5.000 fine and 3 Days vehicle impound at the officer's discretion

 

909. Vehicular Noise Violation (I)
Any person operating a vehicle that emits excessive noise through unnecessary horn usage, or the emittance of loud music without regard to noise pollution is guilty of an infraction, punishable by a fine of $1.000.

910. Tinted Windows (I)
Any person operating a vehicle and unlawfully uses tints, or anonymizing shades on his or her windows leading to an individual driving with tinted windows unable to be identified while driving (( Tints of level 2 or lower are considered illegal. Excluding level 0. )) shall be issued a fine:

1st - $1.000 fine

2nd - $2.500 fine

3rd - $5.000 fine and 1 Day vehicle impound at the officer's discretion

 


911. Jaywalking (I)
Any person who intentionally or recklessly crosses a road as a pedestrian in a manner that creates a foreseeable risk of obstructing the flow of traffic or otherwise creates a hazard to road users is guilty of an infraction, punishable by a fine of $1.000.

912. Possession of Open Container (I)
Any person who holds possession of open containers of alcoholic beverages or any containers carrying performance-altering substances while operating a vehicle is guilty of an infraction, punishable by a fine of $1.000.

913. Failure to Utilize Safety Equipment (I)
Any person who whilst operating a motor vehicle, does not properly secure themselves in with the safety belt, or adhere to traffic safety standards when operating vehicles such as motorcycles, ATV's, etc without a helmet or other proper safety equipment for proper operation is guilty of an infraction, punishable by a fine of $1.000.

914. Operation of Unsafe Motor Vehicle (I)
Any person who drives or moves a motor vehicle, cycle or combination of vehicles on any public road, which is in an unsafe condition as to endanger any person or property, suffers substantial structural damage, or is not equipped with lights, brakes, steering and other equipment in proper condition shall be issued a fine of $5.000 and and may have their vehicle impounded for 2 Days at the officer's discretion.

915. Negligent Operation of Bicycle (I)
Any person operating a bicycle in a manner that will likely cause property damage or harm to other road users or pedestrians is guilty of an infraction, punishable by a fine of $2.000.

 

916. Refusing a Chemical Test (I)
Any person who refuses to take a preliminary breath test or chemical test (breath or blood) at the request of a peace officer when said officer has reasonable grounds indicating that such person has been operating a vehicle under the influence of alcohol or drugs or after any vehicular accident is guilty of an infraction, punishable by a fine of $5.000 and a license suspension.

 

1st Refusal - 3 Days License Suspension

2nd Refusal - 5 Days License Suspension

3rd Refusal - 7 Days License Suspension

 

917. Careless Driving (I)
Any person
driving in a manner that unreasonably interferes with the free and proper use of the public road or highway is guilty of an infraction, punishable by a fine and license suspension.

 

1st - $1.000 fine

2nd - $2.500 fine

3rd - $5.000 fine + 3 Days License Suspension
